1. Zweck und Veranstalter des Angebots

Diese Teilnahmebedingungen und Datenschutzbestimmungen regeln die Bedingungen für die Teilnahme an dem Gewinnspiel der OSRAM GmbH, Marcel-Breuer-Straße 4, 80807 München (OSRAM) sowie die Erhebung und Nutzung der von den Teilnehmern erhobenen oder mitgeteilten Daten.

Mit der Teilnahme am Gewinnspiel akzeptiert der Teilnehmer die folgenden Teilnahmebedingungen und Datenschutzhinweise.

2. Teilnehmer und Teilnahmebedingungen

Teilnahmeberechtigt sind alle Personen, die mindestens 18 Jahre alt sind, ihren Wohnsitz in Deutschland, Österreich oder Italien und ihre Zustimmung zu den Teilnahme- und Datenschutzbestimmungen erklärt haben. Von der Teilnahme ausgeschlossen sind Mitarbeiter der OSRAM GmbH und deren Tochter- und Beteiligungsunternehmen sowie deren Angehörige und Mitarbeiter von am Wettbewerb beteiligten Firmen.

Die Gewinnchance und die Teilnahme sind unabhängig vom Erwerb von Waren oder Dienstleistungen von OSRAM.

OSRAM behält sich das Recht vor, Teilnehmer aufgrund von falschen Angaben, Manipulationen, Verstoß gegen diese Teilnahme- und Datenschutzbestimmungen oder wegen der Verwendung unerlaubter Hilfsmittel (darunter fällt auch die Verwendung von Gewinnspielservices o.ä.) vom Gewinnspiel auszuschließen.

Die Teilnahme am Gewinnspiel ist möglich vom 14.04.25 00:00 Uhr - 27.04.2025 23:59 Uhr.

Der Teilnehmer ist allein verantwortlich für die Richtigkeit, der für die Teilnahme am Wettbewerb angegebenen Daten. Alle personenbezogenen Daten müssen korrekt sein und mit den Daten des Teilnehmers übereinstimmen.

3. Gewinn und Durchführung des Gewinnspiels

Modus:

Die Gewinner werden von einer internen Jury aus allen sich kommentierenden Personen ausgelost.

OSRAM verlost im Rahmen dieses Gewinnspiels:

• 3 Tickets für den Marathon (3 verschiedene Schwierigkeitsgrade), mehr Infos unter: Riva Bike Marathon
• 3 Tickets für das Gravel-Rennen (zwei verschiedene Rennen Long/short), mehr Infos unter: Riva Bike Gravel

Die An- bzw. Abreise und Unterkunft während des Festivals sind nicht Bestandteil der Verlosung und müssen von den Gewinnern selbst getragen werden.

4. Abwicklung des Gewinns

Der Ablauf von der Teilnahme bis zur Verteilung der Gewinne:

1. Kommentieren unter dem Posting zur Verlosung
2. Auslosung der Gewinner durch interne Jury
3. Kontaktaufnahme durch OSRAM Automotive über den Social Media Account der ausgelosten Gewinner
4. Übermittlung der persönlichen E-Mail-Adresse an OSRAM Automotive, ausschließlich zum Versand des Gewinns
5. Die Tickets werden digital per E-Mail an die Gewinner versendet

Im Falle eines unzustellbaren Gewinns ist OSRAM nicht verpflichtet, weitere Nachforschungen anzustellen. Der Anspruch auf den Gewinn verfällt in diesem Fall. Der Gewinnanspruch des Teilnehmers verfällt zudem, falls der Gewinn durch fehlerhafte Datenangaben nicht korrekt zugesandt werden kann.

5. Datenschutzbestimmung

Durch die Gewinnspielteilnahme willigt der Teilnehmer in die Erhebung, Verarbeitung und Nutzung der unter Ziffer 4. aufgeführten personenbezogenen Daten (einschließlich Namens, Adresse) ein. Die Erfassung der geforderten persönlichen Daten im Rahmen des Gewinnspiels dient ausschließlich zur Durchführung des Gewinnspiels durch OSRAM sowie deren beauftragten Firmen, zu deren Zweck sie an diese übermittelt werden. Eine Übermittlung an Dritte erfolgt nicht.

Auch nach Abschluss des Vertrags kann eine Erforderlichkeit, personenbezogene Daten des Vertragspartners zu speichern, bestehen, um vertraglichen oder gesetzlichen Verpflichtungen nachzukommen. So sind etwa im Rahmen unserer geschäftlichen Aufbewahrungsfristen nach Handels- und Steuerrecht Ihre Daten aufzubewahren. Für steuer- und handelsrechtlich relevante Daten gelten gesetzliche Aufbewahrungsfristen von sechs und zehn Jahren. Die Daten der Gewinner sind für die buchungstechnische Abwicklung relevant und als Buchungsunterlagen aufzubewahren. Wir müssen die ordnungsgemäße Durchführung der Verlosung und die Abwicklung der Gewinnbereitstellung innerhalb der gesetzlichen Verjährungsfristen nachweisen.

Verantwortliche Stelle im Sinne des Datenschutzrechts für dieses Gewinnspiel ist die OSRAM GmbH, Marcel-Breuer-Str. 4, 80807 München, Deutschland.

Rechtsgrundlage für die Verarbeitung der Daten ist Art. 6 Abs. 1 lit. b DSGVO.

Sie haben nach den gesetzlichen Vorgaben ein Recht

• Ihre einmal erteilte Einwilligung für die Datenverarbeitung jederzeit mit Wirkung für die Zukunft zu widerrufen,

• Auskunft durch uns über die Sie betreffenden personenbezogenen Daten (Art. 15 DSGVO, § 34 BDSG), d.h. Sie können bei uns Informationen darüber erhalten, welche Daten wir über Sie verarbeiten,

• auf Berichtigung (Art. 16 DSGVO), wenn die bei uns gespeicherten personenbezogenen Daten etwa fehlerhaft oder unvollständig sind,

• Löschung (Art. 17 DSGVO, § 35 BDSG), wenn wir Ihre personenbezogenen Daten nicht weiter speichern dürfen,

• auf Einschränkung der Verarbeitung (Art. 18 DSGVO, § 35 BDSG), wenn wir Ihre personenbezogenen Daten zwar nicht gelöscht werden können bzw. dürfen, aber die Voraussetzungen dafür vorliegen, stattdessen den Zugriff und die Verarbeitung Ihrer personenbezogenen Daten einzuschränken,

• das Recht auf Datenübertragbarkeit (Art. 20 DSGVO), d.h. Ihre durch Sie uns zur Verfügung gestellten personenbezogenen Daten in einem strukturierten, gängigen und maschinenlesbaren Format zu erhalten.

7. Teilnehmer Ausschluss

OSRAM behält sich das Recht vor, Teilnehmer aus dem Wettbewerb auszuschließen, die gegen diese Teilnahmebedingungen verstoßen und / oder manipuliert oder versucht haben, den Teilnahmeprozess oder den Wettbewerb zu manipulieren, z.B. durch Verwendung von Gewinnspielservices. Insbesondere hat OSRAM das Recht, Teilnehmer aus dem Wettbewerb auszuschließen, um obszöne, beleidigende, belastende, ethnisch beleidigende, gewalttätige, pornographische, belästigende, für Minderjährige ungeeignete, rassistische, aufrührerische, fremdenfeindliche, rechtsextreme Fotos und / oder verwerfliche Fotos, Beschriftungen und / oder Kommentare auszuschließen. Wenn die vorgenannten Ausschlussbedingungen gelten, können alle Preise verweigert und nachträglich zurückgefordert werden.

8. Haftung

Für einen Schaden des Teilnehmers haftet OSRAM sowie seine jeweiligen gesetzlichen Vertreter und Erfüllungsgehilfen nur, soweit der Schaden durch OSRAM, seine gesetzlichen Vertreter oder Erfüllungsgehilfen, vorsätzlich oder grob fahrlässig verursacht wurde. Diese Haftungsbegrenzung gilt nicht für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit. Sie gilt ferner nicht bei der Verletzung vertragswesentlicher Pflichten. In einem solchem Fall ist die Haftung von OSRAM der Höhe und dem Grunde nach auf solche Schäden beschränkt, die zur Zeit des Abschlusses des Nutzungsvertrages typisch und vorhersehbar waren. Eine wesentliche Vertragspflicht ist die Pflicht, deren Erfüllung die ordnungsgemäße Durchführung des Vertrages überhaupt erst ermöglicht und auf deren Einhaltung der Vertragspartner regelmäßig vertrauen darf.

9. Sonstige Bestimmungen

Diese Teilnahmebedingungen und die Rechtsbeziehung zwischen dem Teilnehmer und OSRAM unterliegen ausschließlich deutschem Recht.

Sollten einzelne Bestimmungen der Teilnahmebedingungen ungültig sein oder werden, bleibt die Gültigkeit der übrigen Teilnahmebedingungen unberührt.

1. Purpose and organizer of the raffle

These conditions of participation and data protection provisions govern the conditions for participation in the competition organized by OSRAM GmbH, Marcel-Breuer-Straße 4, 80807 Munich (OSRAM) and the collection and use of the data collected or provided by the participants.

By participating in the competition, the participant accepts the following conditions of participation and data protection information.

2. Participants and conditions of participation

All persons who are at least 18 years old, reside in Germany, Austria or Italy and have declared their consent to the terms and conditions of participation and data protection are eligible to participate. Excluded from participation are employees of OSRAM GmbH and its subsidiaries and affiliates as well as their relatives and employees of companies involved in the competition.

The chance of winning and participation are independent of the purchase of goods or services from OSRAM.

OSRAM reserves the right to exclude participants from the competition due to false information, manipulation, violation of these participation and data protection regulations or due to the use of unauthorized aids (including the use of competition services or similar).

Participation in the competition is possible from 14.04.25 00:00 - 27.04.2025 23:59.

The participant is solely responsible for the accuracy of the data provided for participation in the competition. All personal data must be correct and match the participant's data.

3. Winning and implementation of the competition

Mode:

The winners will be drawn by an internal jury from all those who comment.

OSRAM is giving away as part of this competition:

• 3 tickets for the gravel race (two different long/short races), more information at: Riva Bike Gravel

Travel to and from the festival and accommodation during the festival are not included in the prize draw and must be paid for by the winners themselves.

4. Processing of the prize

The process from participation to distribution of the prizes:

1. comment under the post about the prize draw
2. drawing of the winners by an internal jury
3. contact by OSRAM Automotive via the social media account of the drawn winners
4. transmission of the personal e-mail address to OSRAM Automotive, exclusively for sending the prize
5. the tickets will be sent to the winners digitally by e-mail

In the event of an undeliverable prize, OSRAM is not obliged to make any further inquiries. In this case, the entitlement to the prize is forfeited. The entrant's claim to the prize will also be forfeited if the prize cannot be sent correctly due to incorrect data.

5. Data protection regulations

By participating in the competition, the participant consents to the collection, processing and use of the personal data listed under point 4 (including name). The collection of the required personal data in the context of the competition serves exclusively to carry out the competition by OSRAM and its commissioned companies, for the purpose of which they are transmitted to them. The data will not be transmitted to third parties.

Even after conclusion of the contract, it may be necessary to store personal data of the contractual partner in order to comply with contractual or legal obligations. For example, your data must be stored as part of our business retention periods under commercial and tax law. Statutory retention periods of six and ten years apply to data relevant to tax and commercial law. The winners' data is relevant for accounting purposes and must be retained as accounting documents. We must prove the proper execution of the prize draw and the processing of the prize provision within the statutory limitation periods.

7. Exclusion of participants

OSRAM reserves the right to exclude participants from the competition who violate these conditions of participation and/or have manipulated or attempted to manipulate the participation process or the competition, e.g. by using competition services. In particular, OSRAM has the right to exclude participants from the competition in order to exclude obscene, offensive, incriminating, ethnically offensive, violent, pornographic, harassing, unsuitable for minors, racist, inflammatory, xenophobic, right-wing extremist photos and / or reprehensible photos, captions and / or comments. If the aforementioned exclusion conditions apply, all prizes may be refused and subsequently reclaimed.

8. Liability

OSRAM and its respective legal representatives and vicarious agents shall only be liable for damage suffered by the participant if the damage was caused by OSRAM, its legal representatives or vicarious agents intentionally or through gross negligence. This limitation of liability does not apply to damages resulting from injury to life, body or health. Furthermore, it shall not apply in the event of a breach of material contractual obligations. In such a case, OSRAM's liability shall be limited in amount and on the merits to such damages as were typical and foreseeable at the time of conclusion of the contract of use. A material contractual obligation is an obligation whose fulfillment is essential for the proper performance of the contract and on whose fulfillment the contractual partner may regularly rely.

9. Other provisions

These conditions of participation and the legal relationship between the participant and OSRAM are subject exclusively to German law.

Should individual provisions of the conditions of participation be or become invalid, the validity of the remaining conditions of participation shall remain unaffected.
